PREAMBLE – General terms of sale of our training organization :
The present general conditions of sale are applicable to any training order placed by the customer with the training organization through the website http://www.theatremoderne.com, www.regulationemotionnelle.eu and https://admin-c2kom.fr/emotionnelanglais/
Consequently, the fact that the customer validates his registration to the selected training course implies the obligation to pay the price and implies the full and unconditional acceptance of the customer to these general conditions of sale to the exclusion of all other documents which have only an indicative value.
The acceptance of the present general conditions of sale implies, from the moment of the validation of the registration, the formation of a contract to which the training organization and the customer must be mutually bound.
Article 1 – Purpose
The general terms and conditions of sale described hereafter detail the rights and obligations of the company Théâtre Moderne and its customers within the framework of the sale of training courses and online courses.
Any service provided by the Théâtre Moderne company implies the buyer’s unconditional acceptance of these general terms of sale.
Article 2 – Presentation of the products
The characteristics of the products offered for sale are presented in the section « Training catalog or individual support » of our website.
The photographs do not enter the contractual field. The responsibility of the company Théâtre Moderne cannot be engaged if errors are introduced there. All the texts and images presented on the site of the company Théâtre Moderne are reserved, for the whole world, under the copyright and intellectual property, their reproduction, even partial, is strictly prohibited.
Article 3 – Validity period of sales offers
Distance learning is valid for a variable period of time from the date of registration.
Article 4 – Product prices
The » Prices » sections of our website indicate the prices in euros, all taxes included. Théâtre Moderne is not subject to VAT.
Théâtre Moderne reserves the right to modify its prices at any time, but the products ordered will be invoiced at the price in effect at the time the order is registered.
Article 5 – Order
The company Théâtre Moderne confirms the order by e-mail, this information includes all the elements of the order and the right of withdrawal of the customer.
The data recorded by the company Théâtre Moderne constitute proof of the nature, content and date of the order. The latter is archived by the company Théâtre Moderne under the conditions and within the legal deadlines, the customer can access this archiving by contacting the Customer Relations department.
Article 6 – Terms of payment
The payment of orders is made by credit card.
Article 7 – Right of withdrawal
In accordance with the provisions of Article L. 221-18 of the Consumer Code, the customer or his legal representative, if applicable, has a period of fourteen days to exercise his right of withdrawal without having to give reasons for his decision or to bear other costs than those provided for in Articles L. 221-23 to L. 221-25. The exercise of the right of withdrawal can be made by sending a statement, unambiguous, expressing the desire of the customer or where appropriate his legal representative, to withdraw. In application of the regulation n°1182/71/ EEC of the Council of June 3, 1971 determining the rules applicable to periods, dates and terms :
1° The day on which the contract is concluded or the day on which the goods are received is not counted in the period mentioned in Article L. 221-18 ;
2° The time limit begins to run at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the time limit;
3° If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day.
When the right of withdrawal is exercised, Théâtre Moderne will reimburse the client or, if applicable, the client’s legal representative, for all sums paid, including delivery charges, without undue delay and no later than fourteen days from the date on which it is informed of the client’s or, if applicable, the client’s legal representative’s decision to withdraw.
Théâtre Moderne will make the refund using the same means of payment as the one used by the client or his legal representative for the initial transaction.
Article 8 – Late payment (clause applicable to professionals)
In the event of total or partial non-payment of the services provided on the due dates agreed with the user, the buyer must pay Théâtre Moderne a late payment penalty equal to one and a half times the legal interest rate and the termination of access to the online course platform.
The legal interest rate is the one in force on the day of the delivery of the goods.
This penalty is calculated on the amount of the outstanding amount, excluding taxes, and runs from the due date of the price without any prior notice of default being required.
In accordance with articles 441-6 c. com. and D. 441-5 c. com., any delay in payment automatically entails, in addition to the late payment penalties, an obligation for the debtor to pay a fixed indemnity of 40€ for collection costs.
An additional indemnity may be claimed, upon justification, when the collection costs incurred are higher than the amount of the fixed indemnity.
Article 9 – Liability and insurance
Théâtre Moderne is bound by an obligation of means. In no case Théâtre Moderne can be held responsible for a total or partial defect of Internet connection which would not be imputable to him or for the non-control or the breakdowns of the computer equipment of the customer. Théâtre Moderne subscribes and maintains a valid professional insurance.
Article 10 – Force majeure
Théâtre Moderne cannot be held responsible for a breach of any of its obligations under these terms and conditions of sale resulting from the occurrence of a case of force majeure within the meaning of Article 1148 of the Civil Code, as usually retained by French jurisprudence.
Article 11 – Customer relations – After-sales service
For any information, question or claim, the customer can contact from Monday to Friday, from 9 am to 5 pm to the Customer Relations Department.
